Q: What if I wasn’t wearing a seat belt at the time of my auto accident? Can I still recover damages?
North Carolina law allows you to recover full damages even if you were not wearing a set belt at the time of the accident. However, many insurance companies and their lawyers will try to use it to their advantage if they discover you were not wearing a seat belt.
Q: If another driver’s insurance adjuster wants to see my medical records, should I release them?
Absolutely not. You should only release your medical records for limited reasons. Allowing the other driver’s insurance company to view your medical records could cause you to lose your case. Before releasing any medical records be sure to consult with a qualified North Carolina personal injury lawyer.
Q: If I am in a car accident will I have to go to court to recover damages?
That depends on the situation. If it’s without a doubt the other driver was at fault and their insurance company agrees to pay you a reasonable settlement, then no, you are not required to go to court. However, if the other driver’s insurance company feels you may have been at fault, or partially at fault, it might be necessary for your personal injury lawyer to take the case to trial in order for you to recover damages.
Q: If I don’t feel injured after an automobile accident, do I have to see a doctor?
Yes, you and any other passengers in the car should always be checked out by a medical professional after being involved in any type of motor vehicle accident. Often, after an accident certain types of injuries are not immediately present. By having a doctor examine you, injuries might be recognized that otherwise may not show up until a later time. Your insurance probably covers your medical expenses after an accident and if the accident wasn’t your fault, the other driver’s insurance company will be liable to pay the medical bills, both present, and future.
Q: What if I think the auto accident was partly my fault?
You should never admit fault when involved in a car accident. Emotions run high and you’re probably not in the best frame of mind to access a motor vehicle accident. It is best to allow law enforcement officers to do their evaluation of the accident scene. If the accident wasn’t your fault, your personal injury lawyer and staff will do a full evaluation of the accident report and if you are unable to receive compensation from the insurance company, your attorney will take the matter to trial and allow a judge or jury to decide who was at fault.t.
Q: What if the statements I made at the time of the accident are different from my memory of the accident now, can I still win my case?
It’s very common for accident victims to make statements that later on make no sense. During a motor vehicle accident, emotions run high and your adrenaline is up. It’ very easy to say things that might no be correct. This is why it’s very important to contact a personal injury lawyer. Your attorney can evaluate all statements and police reports and help you clarify any incorrect statements you made after the accident.
Q Do I have a lawsuit against the auto manufacturer if my airbags fail to deploy during my auto accident?
There are many factors that determine if your airbags should deploy in an accident. When you hire a personal injury lawyer, they will research the year, make and model of your vehicle so they can determine this information. If it is determined the airbags should have deployed, then you may very well have a lawsuit against the manufacturer.
Q: Do I really need to hire a lawyer if I have a car accident?
A good thing to keep in mind is, the insurance companies have lawyers and so should you. A personal injury lawyer understands the law and can often get you 3-4 times the amount of compensation that you would be able to get on your own. If you’ve been involved in a motor vehicle accident, call King Law Firm today for a Free case evaluation.
