North Carolina Workers’ Compensation allows injured workers to receive medical treatment and wage compensation when disabled due to an injury while on the job. North Carolina Workers’ Compensation does not allow compensation for pain and suffering. Workers’ Compensation Medical Treatment

North Carolina law requires any employer who has three or more employee’s must provide Worker’s Compensation Insurance benefits. When a worker gets injured on the job, either the employer or the employer’s insurance company must pay for medical treatment.  The employee is eligible to receive the medical treatment that will cure the injury, give relief from pain, or lessen the employee’s disability.   There is no co-pay or deductible and no requirement that you miss work to receive medical benefits according to the North Carolina Workers’ Compensation Law. Often there are disagreements between the injured worker and the insurance company regarding medical treatment. According to the North Carolina Workers’ Compensation law, injured workers have the right to request a hearing before the North Carolina Industrial Commission. The Commission can often resolve disagreements on medical treatment issues.

Workers’ Compensation Disability Benefits

North Carolina Workers’ Compensation law allows injured workers who have suffered wage loss due to a compensable work injury are entitled to receive disability payments. Types of Disability Benefits

Disability benefits compensate for wages lost because the illness or injury prevents you from working. Your disability benefits equal to two-thirds of your wages. However, you usually end up receiving as much as your usual wages because you don’t pay income tax.

 

Disability Benefits Are Divided Into Four Categories:

Temporary total disability where you can’t work for a limited period, and ends when you recover, or your doctor says you won’t thoroughly improve. Most workers’ comp disability benefits are from this category.

Temporary partial disabilities apply where you cannot do your regular job for some time, but you can still do some work.

Permanent partial disability is permanent damage inflicted by the injury or illness, which partially impacts your work abilities.

Permanent total disability applies where permanent damage prevents you from returning to your job. You, however, needn’t be entirely disabled or unable to work to receive these benefits.
