Civilians who have been injured while employed by a company that does overseas operations for the U.S. Defense Department may be entitled to Workers’ Compensation benefits.

The Defense Base Act (42 U.S. Code § 1651) provides civilian employees Federal Workers’ Compensation protection when they work (1) at any United States military, air, or naval base outside the country, or (2) under a contract with the United States government for public works or national defense.

Who Is Covered Under The DBA?

In 1941 congress initially adopted the DBA in order to cover workers on military bases located outside of the United States, worldwide. Since then, amendments have increased the DBA’s protections.  It now covers the employees of civilian contractors who complete missions that were typically the responsibility of the US military.

This includes, but is not limited to:

  • Employees under public work contracts with any United States government agency.
  • Employees under Foreign Assistance Act contracts approved and funded by the United States government.
  • Employees of United States companies providing services for the benefit of the military.
  • Employees of American contractors performing public works at a military base in a United States territory outside the continent in support of military assistance programs within allied nations.
  • Employees of private companies on United States military bases used by our government for military purposes.

Below are a few of the companies that hire civilian employees to perform operations for the United States Department of Defense:

  • Halliburton
  • Blackwater
  • AECOM
  • Kellogg, Brown & Root (KBR)
  • DynCorp
  • Global Linguist Solutions
  • DRS Technologies

What are the criteria for Injuries Covered by The DBA?

Workers who have suffered an injury while working on an international base are covered by The Federal Workers’ Compensation. Although the criteria may sound simple, qualifying for DBA can be very complicated. Below are some criteria that help determine the validity of a DBA claim:

Did the Injury occur from a job duty?

Did the Injury occur due to a willful act?

How quickly did the injured party seek treatment?
